Welcome to Creative Sparks. These Terms and Conditions govern your use of our website design and development services. By engaging our services, you agree to these terms in full.
1. Services
Creative Sparks provides website design, development, and related digital services including but not limited to:
- Static website development
- WordPress website design and development
- WooCommerce e-commerce store setup
- Website maintenance and support
2. Payment Terms
2.1 Payment Structure: All projects require 50% advance payment before work begins. The remaining 50% is due upon project completion, before the website goes live.
2.2 Pricing: All prices quoted are fixed and final as displayed on our website. There are no hidden fees or additional charges unless you request features outside the original scope.
2.3 Payment Methods: We accept bank transfers (NEFT/IMPS/UPI), Razorpay, and other standard payment methods. All payments should be made in Indian Rupees (INR).
2.4 Late Payments: If the final payment is delayed beyond 7 days of project completion, we reserve the right to take the website offline until payment is received.
3. Project Timeline and Delivery
3.1 Timelines: Estimated delivery timelines are provided for each package (5-7 days for static sites, 7-10 days for WordPress, 10-15 days for WooCommerce). These timelines begin after we receive the advance payment and all required content from you.
3.2 Client Delays: Delays caused by late content submission, delayed feedback, or slow approvals are not our responsibility. The project timeline will be extended accordingly.
3.3 Revisions: Each package includes a specified number of revision rounds (1 for static, 2 for WordPress, 3 for WooCommerce). Additional revisions will be charged separately.
4. Client Responsibilities
You agree to provide:
- All text content, images, and media for your website
- Timely feedback within 48-72 hours of receiving drafts
- Access to domain registrar and hosting accounts if applicable
- Accurate business information for legal pages and forms
- Payment gateway credentials for e-commerce projects
5. Intellectual Property
5.1 Your Content: You retain ownership of all content (text, images, logos) you provide to us. You warrant that you have the right to use all materials provided.
5.2 Our Work: Upon full payment, you receive full ownership of the completed website. We may display the project in our portfolio unless you request otherwise in writing.
5.3 Third-Party Assets: Any third-party themes, plugins, or stock images used are subject to their respective licenses. Premium licenses purchased for your project are transferred to you.
6. Hosting and Domain
6.1 Domain registration and web hosting are NOT included in our website packages unless explicitly stated.
6.2 We can recommend hosting providers suitable for your needs. The choice of hosting is ultimately yours.
6.3 You are responsible for maintaining active hosting and domain registration after project handover.
7. Post-Launch Support
7.1 All packages include 48 hours of post-launch monitoring for critical bugs only.
7.2 Issues caused by client modifications, hosting problems, or third-party plugins installed after handover are not covered.
7.3 Extended support and maintenance packages are available separately.
8. Refund Policy
8.1 The 50% advance payment is non-refundable once work has begun.
8.2 If you cancel before any work starts, the advance payment will be refunded minus a 10% administrative fee.
8.3 If we are unable to complete the project due to circumstances within our control, you will receive a full refund of all payments made.
9. Limitation of Liability
9.1 Creative Sparks is not liable for any indirect, incidental, or consequential damages arising from the use of our services or your website.
9.2 Our total liability shall not exceed the amount paid by you for the specific project in question.
9.3 We are not responsible for losses due to website downtime caused by hosting providers, cyberattacks, or circumstances beyond our control.
10. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the project. This includes business strategies, customer data, login credentials, and other sensitive information.
11. Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kottayam, Kerala.
12. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Continued use of our services constitutes acceptance of the revised terms.
